Investing In Our Future (Education) — NC 2012-13 Budget Announcement — Legal Action

Governor Perdue has acknowledged the importance of education and investing in our future, and this proposal is a start, however, it SHOULD NOT compromise other public services provided by the hospital, fire department, etc.  We must take a stand NOW, and voice our outrage on the attacks on our educational system.  Action must start at the local level, however, it is the responsibility of our state to provide proper oversight of these matters to ensure equal opportunities for ALL students.  Please put pressure on the Halifax County Board of Commissioners to do what is right for our county, and consolidate our school systems in order to save money, and create one system that benefits ALL of the children in Halifax County, instead of just a chosen few.  Register as a member of nMyGoals and submit a letter of support for this initiative via our “Contact” page.  www.nMyGoals.webs.com  In your subject line type: SAVE EDUCATION IN HALIFAX COUNTY.  Make a donation to the page in order to help support the online initiative to continue to spread the word on this issue.

I beg for assistance from our legal community in addressing this issue.  I believe, should the Halifax County Board of Commissioners refuse to integrate our school systems, at the very least, we may have grounds to pursue actions against them and the State Board of Education with the assistance of the NC Department of Justice for violations to Article IX of the NC Constitution:

Failure to provide a uniform educational system as outlined in Section 2(1) and Section 5

Sec. 2(1).  Uniform system of schools.

(1)        General and uniform system: term.  The General Assembly shall provide by taxation and otherwise for a general and uniform system of free public schools, which shall be maintained at least nine months in every year, and wherein equal opportunities shall be provided for all students.

Sec. 5.  Powers and duties of Board.

The State Board of Education shall supervise and administer the free public school system and the educational funds provided for its support, except the funds mentioned in Section 7 of this Article, and shall make all needed rules and regulations in relation thereto, subject to laws enacted by the General Assembly.

Abuse of powers as granted by Section 2(2) and Section 5 

Sec. 2(2).  Uniform system of schools.

(2)        Local responsibility.  The General Assembly may assign to units of local government such responsibility for the financial support of the free public schools as it may deem appropriate.  The governing boards of units of local government with financial responsibility for public education may use local revenues to add to or supplement any public school or post-secondary school program.

Sec. 5.  Powers and duties of Board.

The State Board of Education shall supervise and administer the free public school system and the educational funds provided for its support, except the funds mentioned in Section 7 of this Article, and shall make all needed rules and regulations in relation thereto, subject to laws enacted by the General Assembly.
